Brothers and sisters in court

Rivalry. The law it tested: executors' and trustees' duties.

What did these cases decide about executors' and trustees' duties?

Without a will, state intestacy law picks the heirs, and the court must rule on every claim of kinship before the estate can be divided. A trust that lets trustees decide whether a beneficiary is ready can keep one heir from his money for decades. Unequal shares plus control in the hands of some heirs makes the others outsiders to a family name they also carry.
