Kumho's board fired one founding brother, the group split in two, and the brothers sued each other for years

Kumho Asiana Group was run under a joint management arrangement among the sons of its founder. On July 28, 2009 the board of Korea Kumho Petrochemical dismissed Park Chan-koo as chief executive and chairman, and his elder brother, group chairman Park Sam-koo, said he would also step down. Chan-koo said his brother had pressured the board and threatened to sue. The group's directors said Chan-koo had broken the joint management arrangement. Sam-koo returned to management in November 2010. Creditors agreed in principle in January 2010 to separate Kumho Petrochemical from the group, and a court later treated the two brothers' businesses as separate. Chan-koo filed a breach-of-duty suit of about $390 million over commercial paper moved to affiliates in December 2009. Sam-koo filed complaints alleging a slush fund and trademark infringement. Kumho Petrochemical dropped its suits against Asiana's board in August 2016. Asiana was later sold, and Sam-koo was convicted of breach of trust†.

What the law took from it

Joint management among brothers has no tie-break, and a crisis will force one.
