Jimmy Buffett left his widow a $275 million trust with his accountant as co-trustee, and each has asked a court to remove the other

Jimmy Buffett died at his home in Sag Harbor, New York, on 1 September 2023, aged 76. His will of 27 April 2017 and his 1990 declaration of trust, last amended on 21 July 2023, put most of his assets into a marital trust for his widow, Jane Buffett, born Slagsvol, who receives all its income for life. The trust requires an independent trustee "at all times." Jane and Richard Mozenter, an accountant at Gelfand, Rennert & Feldman, became co-trustees. Each of the three children received about $2 million. Jane's petition puts the assets at $275 million, including a stake of about 20% in Margaritaville valued at $85.3 million. On 2 June 2025 Mozenter filed in Palm Beach County, Florida, to remove Jane as co-trustee. He alleges she has been "completely uncooperative" and that Buffett structured the trust to keep her from actual control. On 3 June 2025 Jane petitioned Los Angeles Superior Court to remove him. She alleges he took 16 months to produce an income projection, that it showed under $2 million a year, a return below 1%, and that the trust paid him and his firm more than $1.7 million in 2024. In July 2025 her lawyer, Matt Porpora, said she had moved her claims to Florida to avoid litigating in two courts. By March 2026 she had appealed a Florida judge's order letting Mozenter pay his legal costs from the trust; her lawyers called it a "blank check." Mozenter denied her accusations in his response. In September 2026 TMZ reported that Mozenter's discovery requests asked two of the children for any documents about Jane's prescription or non-prescription drug use, including ketamine and marijuana, since August 2023. The children objected that the requests sought "harassing documents." Status: pending in Florida state court; the parties were in discovery in September 2026.

What the law took from it

Pairing a surviving spouse with an independent co-trustee, with no simple way for either to remove the other, leaves any deadlock to the courts.
