Gugu Liberato's will left nothing to the mother of his three children, and a chef who said he was Gugu's partner of eight years sued as well
Gugu Liberato, a Brazilian television host, died after an accident at his home in Orlando, Florida, in November 2019. His 2011 will divided an estate of about R$1 billion: 75 percent to his three children, João Augusto, Marina and Sofia, and 25 percent to five nephews and nieces. His mother, Maria do Céu, was left a pension of R$163,000 a month for life. The will did not name Rose Miriam di Matteo, a physician and the mother of his children, as his partner. She sued to be recognised as his partner in a stable union, which would have given her a share; she asked for half. Then a chef, Thiago Salvático, said he had been Gugu's partner for eight years and sued for the same status. The São Paulo Court of Justice called his relationship with Gugu "clandestine," like a friendship. He called the ruling prejudice and appealed. In June 2023 Minister Nancy Andrighi of the Superior Court of Justice upheld the will and said that even proof of a union would not change it to include Rose. In August 2024 Rose withdrew her suit. The children divide 75 percent of the estate under the will.
A will can exclude a partner, but only a court can decide whether two people were in a union that carries rights.
