Glenn Frey's widow sued Mount Sinai for his death and was ordered to hand over the Eagles' contracts
Glenn Frey died at 67 of complications from rheumatoid arthritis, acute ulcerative colitis and pneumonia. Two days before New York's two-year limit for wrongful death expired, his widow and executor, Cindy Frey, sued Mount Sinai Hospital and gastroenterologist Dr. Steven Itzkowitz in New York State Supreme Court in January 2018. The complaint alleges that from 19 October 2015 into November 2015 the defendants failed to promptly and properly treat his colitis, and that this led to his death. It seeks damages for pain and suffering, wrongful death and loss of a spouse's services. The estate claimed economic losses of $12 million a year, later limited to lost earnings from performance fees and merchandising. The doctor and hospital denied wrongdoing and argued the injuries were caused in whole or in part by the plaintiff's own conduct. In 2019 Justice George J. Silver ruled on the estate's motion to seal the whole file until trial. The defendants demanded Frey's contracts with the Eagles to test his share of concert and music income. On 24 March 2022 the Appellate Division, First Department, affirmed an order requiring the estate to produce the licensing agreements under a confidentiality order. In 2026 no trial verdict or settlement has been reported†. The case is filed in New York County, Index No. 805014/18.
An estate that sues for a musician's lost income must open the band's contracts to the defense.
