Shackleton died about £40,000 in debt, his widow chose his grave on South Georgia, and his brother went to prison for fraud

Ernest Shackleton's younger brother Frank was Dublin Herald in the Office of Arms. On 6 July 1907 the regalia of the Order of St Patrick were found missing from Dublin Castle: a diamond star valued at about £14,000 and a badge valued at £16,000. Sir Arthur Vicars had guaranteed over £750 of Frank's bills to London moneylenders, and Vicars accused Frank of the theft. A Viceregal Commission in 1908 cleared Frank and blamed Vicars, who was forced to resign. The jewels were never recovered. In 1913 Frank was sentenced to 15 months for fraud. After his release he took the name Mellor and died in 1941†. Ernest came back from the Nimrod expedition deeply in debt, and a £20,000 government grant covered the most pressing claims†. He died of a heart attack aboard Quest on 5 January 1922, aged 47. Leonard Hussey took the body as far as Montevideo, where a telegram arrived saying Lady Shackleton wanted her husband buried on South Georgia. He was buried at Grytviken on 5 March 1922. He died about £40,000 in debt, with personal effects valued at £556†. Emily accepted charity. In 1929 George V gave her a grace-and-favour apartment at Hampton Court, where she died in 1936. Frank Wild's ashes were buried beside Shackleton's grave in 2011†. Endurance was found on 5 March 2022 at 3,008 metres in the Weddell Sea and is a protected monument. Quest was found on 9 June 2024 at 390 metres in the Labrador Sea.

What the law took from it

If debts can exceed assets, the family home and the widow's income need to be held outside the explorer's own estate.
